Driver-licence suspension in New Zealand

driver-licence Reviewed 2 min read
Short answer

A suspension can arise through different routes. 100 or more demerit points within two years leads to a three-month suspension once served. Serious speeding or alcohol offending can trigger an immediate 28-day roadside suspension. A fine payment, court date or expired calendar period does not by itself prove you may drive again. Follow the notice, surrender and reinstatement requirements for your specific suspension and confirm status with NZTA.

The demerit guide covers the most common accumulation route. “Suspended” describes the effect — no legal driving entitlement during the specified period — but not one single cause. The paperwork and return process depend on whether the trigger was demerit points, a serious roadside offence, a court order, medical action or another statutory power.

Demerit suspension

When 100 or more active demerit points accumulate within two years, the consequence is a three-month suspension. Service matters: NZTA's process identifies how the notice is served and what happens to the licence. Do not evade service or treat delay as extra permission; obtain official confirmation of status.

Immediate roadside suspension

Police can issue a 28-day suspension for defined serious conduct. NZTA identifies officer- detected speed more than 40km/h above a permanent limit or more than 50km/h above a temporary limit, and specified high alcohol results, among the triggers.

The 28 days do not replace every other consequence. An infringement, criminal charge, demerit record, impound process or later disqualification may follow its own track.

Do not drive to work, move a vehicle “just once” or test whether an online checker has updated. Driving while suspended is a new legal problem. Arrange another licensed driver, delivery, storage or towing as the situation requires.

Count from the document, then confirm

Keep the notice and record when and how it was served. Check whether you had to surrender the physical licence and what the official instructions say about return or replacement. Calendar arithmetic alone can miss a start date, overlapping order or administrative requirement.

Before driving again, confirm your licence status through NZTA using your own details. KiwiVehicle does not ask for or access the record. If there is a court order, a disputed service date or a need to apply for a limited licence, get New Zealand legal advice promptly; those outcomes cannot be safely inferred from a generic page.

Frequently asked questions

How long is a demerit-point suspension?
Reaching 100 or more active demerit points within two years leads to a three-month suspension once the suspension is served.
What is a 28-day roadside suspension?
Police can impose it for specified serious offences, including certain high-speed and alcohol allegations. It is separate from the 100-point process and can sit alongside later proceedings.
Can I drive as soon as the dates appear to be over?
Do not rely only on your count. Check the notice for start, service, surrender and return requirements, and confirm your status through the official NZTA route before driving.
Can I get a work licence?
Limited-licence eligibility is legal advice and depends on the suspension or disqualification type. Some immediate suspension circumstances do not allow one. Speak to a New Zealand lawyer promptly rather than assuming work need creates an exception.
